All services are provided on a best-effort basis. We do not guarantee any specific results, including but not limited to sales, revenue, profit, or return on ad spend.

2. No Guarantees

You acknowledge and agree that:

  • Marketing and advertising results vary.

  • We do not guarantee profits, revenue, sales, or business growth.

  • Past performance is not indicative of future results.

  • You are solely responsible for your business decisions and outcomes.

3. Client Responsibilities

You agree to:

  • Provide accurate and complete information about your business.

  • Maintain ownership and control of your advertising accounts.

  • Be responsible for all advertising spend and platform fees.

  • Grant us appropriate access to advertising platforms as needed.

You are responsible for complying with all platform policies (including TikTok, Instagram, and any others).

4. Payments & Fees

Unless otherwise stated:

  • All payments are non-refundable.

  • Late payments may result in suspension or termination of services.

  • You are responsible for all advertising spend paid directly to advertising platforms.

5. Limitation of Liability

To the maximum extent permitted by law, Pump Ads shall not be liable for:

  • Any loss of profits, revenue, or business opportunities.

  • Any advertising losses or negative campaign performance.

  • Any indirect, incidental, special, or consequential damages.

Our total liability for any claim shall not exceed the amount you paid us for services in the preceding 30 days.

6. Intellectual Property

All materials, content, and processes created by Pump Ads remain our intellectual property unless otherwise agreed in writing.

You are granted a limited, non-exclusive right to use deliverables created specifically for your business.

7. Termination

We reserve the right to terminate or suspend services for:

  • Non-payment

  • Violation of these Terms

  • Abusive or unlawful behavior

Either party may terminate services with written notice, subject to any separate service agreement.

8. Third-Party Platforms

Pump Ads is not responsible for:

  • Changes to platform policies

  • Account suspensions or bans

  • Platform outages or technical issues

9. Disclaimer

All services are provided “as is” and “as available.” We make no warranties regarding the effectiveness or profitability of our services.

10. Governing Law

These Terms shall be governed by the laws of the State of New York, United States.
